Default Notice

Creditors are legally obliged to advise you in writing that you have missed payments. This will come in the form of a default notice. You will be informed of what action the creditor may consider if you do not come to an arrangement with them. Details shown in the default notice include;

  • The full name and address of the creditor issuing the default notice and the full name and address of the borrower
  • The type of agreement and full details of how the agreement was breached
  • The early settlement figure (for fixed sum only)
  • Action you can take to remedy the situation and comply with the agreement
  • The proposed action by the creditor if you don't comply with the agreement

Debt Collection

A collection agency is a business that pursues payments on debts owed by individuals or businesses. Most collection agencies operate as agents of creditors and collect debts for a fee or a percentage of the total amount owed.

Creditors have to follow certain laws and guidelines for the collection of any monies owed. One of these laws covers harassment by creditors.

If you feel that you are being harassed by a creditor this could be classed as a criminal offence. The Protection from Harassment Act 1997 makes it a Criminal Offence for any person to pursue a course of action "which they know, or ought to know, amounts to harassment of another person". The Office of Fair Trading (OFT) has produced a set of Debt Collection and Debt Management Guidelines which sets out the types of debt collection practices which the OFT considers to be unfair.

If you think a creditor has broken the law or has breached these guidelines- you should first raise it with the creditor or collector concerned.

County Court Judgements (CCJ)

A CCJ can be issued for any unsecured debt to which you have not paid the contractual payment. Any individual or firm that you owe money to can issue a judgement.

The claimant (the creditor) will have to apply to the court for a claim form to be issued. The claim form will be sent to you detailing how much the creditor has claimed you owe. You will also receive a response pack with the claim form which will include the following;

  • Defence Form - If you disagree with the amount of the claim this is the form you need to complete;
  • Admission Form - If you admit to owing the full amount claimed you should complete this form.
  • Acknowledgment of Service - If you require extra time to complete or defend the claim you need to complete this form. This will give you 28 days rather than 14 days to reply.
